Immigration

Our law office is dedicated to immigration and nationality law. We focus on family based immigration petitions, deportation defense, and victim advocacy, while also handling a substantial amount of appellate work before the Board of Immigration Appeals and the Ninth Circuit Court of Appeals.

Petitions before the United States Citizenship and Immigration Services:

Consular Processing

Regularly represent spouses, children, and parents, of lawful permanent residents and United States citizens who are eligible to become green card holders after interviews with U.S. Consulates abroad. This includes the filing of both I-601 and I-601A waivers for persons subject to unlawful presence bars.

Citizenship and Naturalization

Naturalization is the process by which U.S. citizenship is granted to a foreign citizen or national after he or she fulfills the requirements established by congress in the Immigration and Nationality Act.

There are five categories through which a beneficiary can obtain permanent residency.  We can help you assess whether you or your prospective employee meets the requirements, and we will review all necessary documents. Employment-based visas can take anywhere from 12 to 24 months to complete and the basic requirements are based on the following criteria:

  • Employee must prove eligibility for the position

  • Job must be acceptable and employee must be qualified for the position

  • Employer must prove eligibility for hiring a foreign employee

Asylum and Refugee Status

An immigrant is eligible for refugee status or asylum if she has been persecuted or fears she will be persecuted because of her race, nationality, religion, and/or membership or opinions related to a social group or political opinion.

Asylum

This status is a type of protection available to individuals who:

  • Meet the definition of a refugee;

  • Are already present in the U.S.; or

  • Are seeking admission at a port of entry.

An individual may apply for asylum in the U.S. regardless of his or her country of origin or lack of immigration status.

Refugee

A person may be granted refugee status if she meets the definition of refugee and is of a special humanitarian concern for the U.S. Typically, refugees are people outside of their country who are unable or unwilling to return home because they fear serious harm.
